Claiming surplus funds in Ottawa County
Surplus from sales in Ottawa County is held by the county office that conducted the sale, typically the clerk, auditor, or treasurer. We confirm the holding office before anything is filed.
Okla. Stat. tit. 12, § 773 requires judicial-sale overplus to be paid on demand to the defendant after the writ, interest and costs. Contractual power-of-sale proceeds instead follow tit. 46, § 48, which provides priorities and court deposit for disputed funds. Neither provision sets a fixed general owner surplus cutoff; demand from the sheriff or mortgagee, or apply to district court for deposited proceeds. Appraisal and six-month sale-delay rules concern sale procedure, not surplus.
