Mortgage foreclosure surplus

Okla. Stat. tit. 12, § 773 requires judicial-sale overplus to be paid on demand to the defendant after the writ, interest and costs. Contractual power-of-sale proceeds instead follow tit. 46, § 48, which provides priorities and court deposit for disputed funds. Neither provision sets a fixed general owner surplus cutoff; demand from the sheriff or mortgagee, or apply to district court for deposited proceeds. Appraisal and six-month sale-delay rules concern sale procedure, not surplus.

Tax sale surplus

Okla. Stat. tit. 68, § 3131(C) governs county tax-resale excess in a separate fund for the record owner at the start of resale. The owner must withdraw excess within one year of resale. Remaining money then enters the county resale property fund. Assignments made on or after the start of resale are invalid; this is separate from the claim period.

Unclaimed funds

Okla. Stat. tit. 60, §§ 651 et seq. govern unclaimed property, with State Treasurer claims under § 674. Section 674 sets no fixed general initial owner-claim cutoff. Its 90-day review period begins after a complete claim is filed.
