Mortgage foreclosure surplus

R.I. Gen. Laws § 34-11-22 provides the power-of-sale mortgage form and requires the mortgagee to account and pay surplus after secured sums and expenses to the mortgagor or successors. Section 34-11-22 sets no fixed post-sale owner surplus cutoff. Request accounting and payment promptly; a civil action may be needed if the mortgagee does not pay. Section 34-27-4 concerns sale notice, and sale timing is separate.

Tax sale surplus

R.I. Gen. Laws § 44-9-37 governs surplus from a municipal tax-property sale without foreclosure, deposited with the city or town treasurer for the entitled person. That person must demand the surplus within five years, or it goes to the city or town. The one-year wait before a purchaser may petition to foreclose redemption under § 44-9-25 is separate.

Unclaimed funds

R.I. Gen. Laws ch. 33-21.1 governs unclaimed property, with administrator claims under § 33-21.1-24. Section 33-21.1-24 sets no fixed general initial owner-claim cutoff for state-held property. The five-year municipal tax-surplus limit under § 44-9-37 is separate.
