Claiming surplus funds in Traill County
Surplus from sales in Traill County is held by the county office that conducted the sale, typically the clerk, auditor, or treasurer. We confirm the holding office before anything is filed.
N.D. Cent. Code §§ 32-19-10–11 govern judicial mortgage surplus sent to court after debt and costs for ordered distribution. Under § 32-19-10, surplus under $1,000 is forfeited to the county if no court application is filed within 60 days after deposit. For surplus of $1,000 or more, § 32-19-11 allows investment after 90 days for the defendant or successors. The larger amount does not have the same forfeiture rule.
