Mortgage foreclosure surplus

N.J. Stat. Ann. § 2A:50-37 governs mortgage sheriff-sale surplus deposited with Superior Court and paid by court order on application. N.J. Ct. R. 4:64-3 provides the supported surplus-money motion procedure. Section 2A:50-37 sets no fixed initial application cutoff. The Rule 4:65-5 ten-day sale-objection period is a different procedure.

Tax sale surplus

N.J. Stat. Ann. §§ 54:5-86–87 and P.L. 2024, c.39 govern equity after tax-certificate foreclosure; for covered nonabandoned property, an owner or heir must demand an equity-preserving sheriff judicial sale or Internet auction in writing before final judgment under § 54:5-87(b). Sale surplus is deposited with court and claimed under § 2A:50-37. That section sets no separate fixed initial cash-claim cutoff, and application is made to Superior Court. Abandoned-property cases have different rules.

Unclaimed funds

N.J. Stat. Ann. §§ 46:30B-1 et seq. govern unclaimed property held by the Department of the Treasury. The state claim process sets no fixed general owner-claim deadline for property in state custody. New Jersey's Unclaimed Property Administration says ownership stays with the owner until a valid claim is processed.
