Mortgage foreclosure surplus

Mass. Gen. Laws ch. 244, § 36 allows a mortgagor or other entitled person to recover excess received by the mortgagee in a civil action, absent a redemption suit. Chapter 244 governs foreclosure, and § 36 sets no special filing period for the excess-proceeds civil action. Applicable civil limitations and the facts of receipt must be assessed. A right to cure default or redeem property is separate.

Tax sale surplus

Mass. Gen. Laws ch. 60, § 64A, under St. 2024, c. 140, as amended in 2025, governs excess equity when a municipality or tax-receivable purchaser sells or retains property after a Land Court tax-foreclosure judgment. If the owner cannot be identified and located, § 64A(d)(3) allows 18 months after the excess-equity notice for a written claim. Unclaimed equity transfers under ch. 200A after 19 months from sale or appraisal under § 64A(e). A Superior Court dispute action must be filed within 12 months after the itemized-accounting notice under § 64A(f).

Unclaimed funds

Mass. Gen. Laws ch. 200A governs unclaimed property surrendered to the State Treasurer, with owner claims under § 10. Section 10(a) allows a claim at any time after surrender. Before transfer, a tax-foreclosure claim against the judgment holder still follows ch. 60, § 64A.
