Mortgage foreclosure surplus

KRS § 426.500 governs execution-sale surplus, paying an excess cash price to the defendant owner or using a bond payable to that owner in a credit sale. Mortgage foreclosure also requires the court judgment and master commissioner's accounting, and § 426.500 sets no special surplus deadline. KRS § 426.530 gives a six-month redemption right when the price is below two-thirds of appraisal. That right concerns reacquiring the property, not claiming surplus.

Tax sale surplus

A county delinquent-tax certificate sale under KRS ch. 134 is separate from later judicial lien foreclosure under § 134.546. First-class-city collector actions use §§ 91.481–91.527, with § 91.517 governing any court-distributed remainder. Amended § 91.517(3), effective July 15, 2026, sends unclaimed first-class-city collector-foreclosure proceeds to escheat if no entitled person appears and claims within two years after sale. Other tax-certificate foreclosure proceeds follow the court order and applicable execution law.

Unclaimed funds

KRS ch. 393A governs unclaimed property, with owner claims to the State Treasurer under § 393A.510. Section 393A.510 sets no fixed initial owner-claim cutoff. The administrator decides within 90 days under § 393A.520. A claimant may request an administrative hearing within one year after filing under § 393A.540.
