Mortgage foreclosure surplus

Idaho Code § 45-1507(3) governs nonjudicial trustee-sale surplus, paying expenses, the secured obligation and qualifying junior liens before the grantor or successor. Section 45-1507 sets no fixed grantor filing period for residual proceeds. Judicial foreclosure follows separate court-supervised rules in Title 6. Section 45-1508 eliminates post-sale deed-of-trust redemption, not the right to claim surplus.

Tax sale surplus

Idaho Code § 31-808(2)(b)–(d) governs county sales of tax-deeded property, including priority claims, any residual paid to the tax-deed record owner, and remaining unclaimed money sent to the State Treasurer. The county must notify parties in interest within 30 days after sale. A party in interest has 60 days after receiving notice to claim; late claims are barred under § 31-808(2)(b). Pre-sale tax-deed and property-redemption timing is separate.

Unclaimed funds

Idaho Code tit. 14, ch. 5, effective 2024, governs revised unclaimed property, including §§ 14-5-801 and 14-5-901, with claims administered by the State Treasurer. Under § 14-5-801(2), certain school-endowment escheat and unidentified-owner funds can become unredeemable after ten years. Other property remains redeemable. The fund category determines the applicable claim rule.
