Mortgage foreclosure surplus

10 Del. C. §§ 5065–5067 govern mortgage sheriff-sale surplus, and § 5067 requires the officer to render the balance after debt, interest and costs to the owner at sale. Section 5067 sets no fixed owner filing cutoff. Under § 4986, money the sheriff cannot pay may enter court when the recipient is absent, unknown or unable to receive it. A mortgage sale after confirmation conveys free of the mortgagor's equity of redemption under § 5066.

Tax sale surplus

Delaware tax-sale routes differ by county, with Title 9, Chapter 87, Subchapter II governing monition sales. Section 8779 requires immediate excess payment to the owner in the Kent and Sussex route, or an identifiable bank deposit if the owner cannot accept payment, without an owner cutoff. New Castle's alternative route is in Subchapter III; §§ 8758 and 8760 allow owner redemption within 60 days after court confirmation and a separate one-year lienholder redemption petition period. These are property-redemption periods, not surplus-claim deadlines.

Unclaimed funds

12 Del. C. Chapter 11, Subchapter II governs unclaimed property, with initial owner claims to the State Escheator under § 1165. Section 1165 sets no fixed initial owner-claim deadline. Section 1167 allows 120 days after an Escheator determination to request Tax Appeal Board review. An appeal to the Court of Chancery must be filed within 30 days after the board's decision.
