Claiming surplus funds in Sacramento County
Surplus from sales in Sacramento County is held by the county office that conducted the sale, typically the clerk, auditor, or treasurer. We confirm the holding office before anything is filed.
Cal. Civ. Code §§ 2924j and 2924k govern nonjudicial trustee-sale surplus, paying sale costs, secured debt, junior liens by priority, then the trustor or successor. Under § 2924j(a), the trustee sends notice within 30 days after executing the trustee's deed, and the claimant has 30 days after notice is sent to submit a written claim. If disputed money is deposited with the court, a claimant has 30 days after the court-deposit notice to claim there under § 2924j(d). These surplus procedures are separate from property redemption.
